Stage One Washington State Environmental Policy Act (“SEPA”) Reforms Adopted

In 2012, the Washington legislature directed the Department of Ecology to revisit and amend SEPA rules to streamline the permit process. The Department of  Ecology will be doing this in a two-step process. The first process was concluded on December 31, 2012. The second concludes on December 31, 2013.  Here are the new adopted rules and exemptions from the first process that will go into effect on January 28, 2013.  The changes include increasing exemption thresholds for a variety of land uses and providing flexibility to local governments in adopting minor new construction thresholds.

Our firm submitted comments to the Department of Ecology during the stage one process and will continue to monitor as stage two progresses.  Stay tuned to this blog for updates regarding the stage two process.
